01 Acceptance of Terms

By accessing or using the LiftWorks USA website (liftworksusa.com) or by purchasing equipment from us, you agree to these Terms of Service and our Privacy Policy. These terms apply to all visitors, customers, and parties who access or use our services.

LiftWorks USA reserves the right to update or modify these terms at any time without prior notice. Continued use of the site following any changes constitutes your acceptance of the revised terms.

02 Equipment Sales & Condition

LiftWorks USA sells used and refurbished material handling equipment. All equipment is sold in "as-is, where-is" condition unless a specific written warranty is included in the final sales agreement.

• Equipment listings describe the unit's condition to the best of our knowledge at the time of listing. Condition may change as units are inspected, repaired, or sold.
• All sales are final once a deposit has been received and a sales agreement has been executed, unless otherwise agreed to in writing.
• Photographs and descriptions are provided for general reference only and may not reflect every detail of the unit's condition.
• Buyers are encouraged to arrange an inspection prior to purchase. LiftWorks USA can assist in coordinating third-party inspections upon request.

03 Pricing & Payment

All prices listed on this website are in U.S. dollars and are subject to change without notice. A price quote provided by a LiftWorks USA representative is valid for the period stated in the quote or, if no period is stated, for 48 hours from the time of issuance.

• A deposit is required to hold a unit. Units are not reserved until a deposit is received and confirmed.
• Accepted payment methods include wire transfer, ACH, certified funds, and credit card (subject to applicable processing fees). We do not accept personal checks for final payment.
• Full payment must be received before equipment is released for pickup or delivery.
• Buyers are responsible for all applicable taxes, fees, and freight charges unless otherwise specified in writing.

04 Shipping & Delivery

LiftWorks USA ships equipment nationwide across the contiguous 48 states. International sales are accepted — contact us for a shipping quote prior to purchase.

• All shipments are coordinated via third-party freight carriers. LiftWorks USA is not responsible for carrier delays, damage in transit, or acts of nature once equipment has been released to the carrier.
• Unless otherwise agreed, all sales are made EXW (Ex Works) from our facility in Colton, California. Risk of loss transfers to the buyer upon release to carrier.
• Buyers must inspect equipment upon delivery and note any visible freight damage on the delivery receipt before signing. Failure to do so may limit your ability to file a freight claim.
• Estimated delivery times are provided for reference only and are not guaranteed.

05 Warranty

Unless explicitly stated in a written sales agreement, all equipment is sold without warranty. LiftWorks USA makes no representations or warranties, express or implied, as to the merchantability or fitness for a particular purpose of any unit sold.

Where a limited warranty is offered in writing, its terms, duration, and coverage will be specified in the sales documentation. Warranty coverage, if provided, does not transfer to subsequent buyers.

06 Returns & Cancellations

All sales are final. LiftWorks USA does not accept returns of equipment once a sale is complete and the unit has been released.

• Deposits are non-refundable if the buyer cancels after a sales agreement has been executed.
• Cancellations prior to execution of a sales agreement may be eligible for a full or partial deposit refund at LiftWorks USA's discretion.
• If LiftWorks USA is unable to deliver the equipment as described due to circumstances within our control, we will work in good faith to offer a replacement, credit, or refund.

07 Use of This Website

You agree to use this website only for lawful purposes. You may not use this site to:

• Transmit any unsolicited commercial communications or spam.
• Attempt to gain unauthorized access to any part of our website or systems.
• Scrape, harvest, or collect data from this site without express written permission.
• Post or transmit any content that is unlawful, harmful, or misleading.

LiftWorks USA reserves the right to restrict or terminate access to this website at any time, for any reason, without notice.

08 Intellectual Property

All content on this website — including text, images, logos, graphics, and design — is the property of LiftWorks USA or its content suppliers and is protected by applicable intellectual property laws.

You may not reproduce, distribute, or create derivative works from any content on this site without express written consent from LiftWorks USA.

09 Limitation of Liability

To the fullest extent permitted by applicable law, LiftWorks USA shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of this website or any equipment purchased from us.

In no event shall LiftWorks USA's total liability to you for any claim arising from these terms or your purchase exceed the amount you paid for the equipment giving rise to the claim.

10 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or related to these terms shall be subject to the exclusive jurisdiction of the courts located in San Bernardino County, California.

11 Severability

If any provision of these Terms of Service is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
